Terms of Service

1. Scope and provider

These terms govern the use of AutoChart.eu, operated by Phil Taubert, Kapellenstr. 9B, 04315 Leipzig, Germany ("we"). The German version is authoritative; this English version is provided for convenience.

2. The service

AutoChart.eu automatically converts audio files you upload into song folders for rhythm games (e.g. YARG, Clone Hero). Charts are generated fully automatically by AI; no specific quality of the result is owed. If a conversion fails, the spent credit is refunded automatically.

3. Account and free trial

An account is required to use the service. Only one account per person is permitted. Once the email address is verified, one free conversion of a song of up to 10 minutes is available. It is granted once per mailbox (variants of the same address, e.g. with a "+" suffix, count as the same mailbox); disposable email addresses are excluded. There is no entitlement to the free trial.

4. Credits and prices

Further conversions require credits, purchased as packs. Sale and payment processing are handled by Stripe Managed Payments; Stripe acts as the seller (merchant of record), issues the invoice and remits VAT. Stripe's terms shown at checkout additionally apply to the payment. 1 credit converts one song of up to 10 minutes; songs over 10 and up to 20 minutes use 2 credits. Credits do not expire and are not transferable. All prices include VAT. Credits cannot be paid out in money.

5. Refer a friend

Every account gets a personal invite link. Anyone who creates an account or signs in through this link, has not bought credits yet and has not accepted another invite receives bonus credits with their first purchase of one of the packs named on the invite page. The inviting person receives bonus credits once the period named on the invite page has passed since that purchase. Bonus amounts, eligible packs and the period are those shown on the invite page at the time of the purchase.

An invite can be accepted only once per person and mailbox; variants of the same address count as the same mailbox, also after an account is deleted and created again. Your own accounts and addresses cannot be invited. If the purchase is paid with a card that has been used on the inviting person's account, neither person receives a bonus.

If the purchase is refunded or withdrawn, or the payment is disputed or reported as suspicious by the bank, the inviting person's bonus lapses; bonus credits already granted are deducted again as far as they are still available. Bonus credits granted with a purchase lapse if that purchase is withdrawn. Bonus credits are used like purchased credits but have no monetary value and are not refunded.

Invite links must not be distributed unsolicited on a large scale (e.g. spam). In case of abuse we may remove bonuses and suspend accounts under section 10. There is no entitlement to take part; we may change or end the program for the future, bonuses already credited are not affected.

6. Right of withdrawal

Consumers generally have a 14-day right of withdrawal. For purchased, not yet used credits you may withdraw within 14 days by email; used credits are deducted proportionally. By starting a conversion you request immediate performance of the digital service and expressly acknowledge that you lose your right of withdrawal for that service once it has been fully performed (§ 356(5) German Civil Code, implementing Directive 2011/83/EU).

7. Your obligations: rights to content

You may only upload audio files for which you hold the necessary rights (e.g. your own music, royalty-free music or properly licensed works). Generated results may only be used for personal, non-commercial purposes and must not be distributed publicly. You alone are responsible for infringements caused by uploaded content and will indemnify us against third party claims, unless you are not at fault.

8. Availability

We aim for high availability but do not owe uninterrupted accessibility. Maintenance and outages may temporarily limit the service.

9. Liability

We are liable without limitation for intent, gross negligence and injury to life, body or health. For simple negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this kind of contract. Any further liability is excluded.

10. Termination and account deletion

You can delete your account at any time in your profile settings; unused credits lapse, an existing right of withdrawal remains unaffected. We may suspend or terminate accounts in case of material breaches of these terms.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers this applies only insofar as mandatory consumer protection rules of their country of residence do not provide otherwise. Should individual provisions be invalid, the remainder of the contract remains effective.
